Possession

Possession denotes actual control over a thing and the legal consequences attached to that control. Actions for the recovery of possession and the prevention of disturbance brought where possession has been usurped or disturbed, applications to the local administrative authorities, and the determination of the actual use of real estate are the main subjects of this field.

The liability of possessors in good and bad faith, proof of the transfer of possession, the transfer of possession of unregistered real estate and claims for registration based on possession also fall within this field; these claims are addressed together with cadastral determinations and actions for registration through extraordinary acquisitive prescription.
