Condominium Law
Condominium law encompasses ownership of the independent units of a building and the rights and obligations arising from its common areas. Disputes concerning the conversion of condominium easement (kat irtifakı) into condominium ownership, the preparation and amendment of the management plan, the correction of land shares, and deficiencies in project and occupancy permits come first in this field.
The annulment of resolutions of the owners’ assembly, the appointment of managers and auditors, the collection of common expenses and service charges, disputes over the use of common areas and the use of independent units for purposes other than those intended, and compelling an owner who seriously breaches their obligations to transfer their unit are also among the subjects of condominium law. Claims for the removal of alterations made to independent units and of interventions in common areas are addressed together with the zoning status and permit records of the building.
