Inheritance Law
Inheritance law encompasses the stages from the opening of the succession to the partition of the estate. Obtaining a certificate of inheritance, determining the estate, renunciation of the inheritance and the official liquidation of the estate are among the first of these stages; where the heirs agree, an estate partition agreement is drawn up and the land registry procedures are completed, and where no agreement is reached, partition is effected through an action for the dissolution of co-ownership (izale-i şuyu).
Actions for reduction (tenkis) protecting the rights of heirs entitled to a reserved portion, actions for annulment of title and registration brought against transfers simulated by the decedent to deprive the heirs of their share (muris muvazaası), the opening and annulment of wills and the annulment of certificates of inheritance also fall within this field. The preparation of wills and inheritance contracts during the decedent’s lifetime and the determination of the title, zoning and cadastral status of the real estate in the estate are among the matters in which inheritance law intersects with real estate law.
