Enforcement and Bankruptcy Law

Enforcement and bankruptcy law encompasses matters relating to the compulsory collection of receivables through the state and the liquidation of the debtor’s assets in the event of insolvency. Enforcement proceedings with and without a judgment, proceedings based on bills of exchange and for the realisation of pledges, and attachment, sale and distribution procedures are the main subjects of this field.

For the debtor, objections to enforcement, complaints, and actions for negative declaration and restitution; for the creditor, actions for the annulment and removal of objections, interim attachment, actions to set aside transactions (tasarrufun iptali) and third-party ownership claims, as well as bankruptcy liquidation and objections to the ranking table, are also among the subjects of enforcement and bankruptcy law.

For debtors unable, or at risk of being unable, to pay their debts as they fall due, the request for concordat, the temporary and definitive moratorium stages, and the voting and approval of the concordat project, and, for creditors, objections to the concordat and actions concerning disputed receivables, also fall within this field.
