Administrative Law
Administrative law encompasses disputes arising from the acts and actions of the administration and the remedies available against them. Annulment actions against administrative acts, full remedy actions for damage arising from the administration’s acts and actions, applications to the administration and requests for stay of execution form the core of this field.
In respect of real estate, administrative law finds application in actions against zoning plans and plan amendments, land readjustment procedures and readjustment share deductions, building and occupancy permit procedures, demolition orders and zoning fines, as well as public interest decisions and expropriation acts. Applications to the administration concerning real estate reserved for public services by a plan but left unexpropriated for a long period, risky building and risky area decisions, decisions of the municipal executive committee (encümen), the lease and sale of Treasury and municipal real estate, and notices of compensation for unlawful occupation (ecrimisil) are also included.
Disputes arising from licence, permit and authorisation procedures, administrative fines, and tender and administrative contract relationships are also among the subjects of administrative law.
